Privacy Policy
Effective Date: October 2, 2026
Clark St Homes LLC (“Clark St Homes,” “we,” “us,” or “our”) buys houses directly from property owners. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit www.clarksthomes.com (the “Site”), submit a form, use our chat or voice assistant, or communicate with us by phone, text, email, or mail.
This Policy covers information collected by Clark St Homes. It does not cover third parties whose services are linked from or built into the Site.
1. Scope and Eligibility
The Site is intended for property owners in the United States who are 18 or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it.
The Site does not offer or sell securities or investment opportunities.
2. Information We Collect
(a) Information you provide. When you submit a form, chat with us, call, text, email, or reply to our mail, we collect what you give us. This may include:
- your name, phone number, email address, and mailing address;
- the property address and details about the property, such as its condition, occupancy, mortgage or lien status, and your asking price;
- your reason and timeline for selling;
- the content of your messages, calls, and chat or voice conversations; and
- documents you send us in connection with a sale.
(b) Information collected automatically. When you use the Site, we and our service providers collect device and browser information (IP address, browser type, operating system), usage information (pages visited, time on page, referring URL), and information from cookies and similar technologies described in Section 6.
(c) Information from other sources. We obtain information about properties and their owners from public records, such as land records, tax assessor data, and court filings, and from commercial data providers. This can include owner names, mailing addresses, phone numbers, and email addresses. We use it to identify properties we may want to buy and to contact their owners. If you received mail or another communication from us without contacting us first, this is how we obtained your information.
(d) Chat and voice assistant. The Site’s chat and voice assistant is provided by Elevista LLC through its Elevista Connect product. It collects, processes, and stores the content of your conversation. You are told at the start of the interaction that you are communicating with an AI assistant and, for voice, that the conversation is recorded.
3. How We Use Information
We use personal information to:
- respond to your inquiry and communicate with you about your property;
- evaluate the property and prepare and present a purchase offer;
- negotiate, document, and close a purchase, including work with attorneys, title companies, and lenders;
- identify properties we may want to buy and contact their owners by mail, phone, text, or email, as described in Section 4;
- keep records of consent and of requests not to be contacted;
- operate, secure, and improve the Site and our services;
- comply with legal, tax, and recordkeeping obligations; and
- detect and prevent fraud, security incidents, and unlawful activity.
4. Calls, Texts, AI Voice, Email, and Mail
(a) Text messages. If you give us your mobile number and consent to receive texts, we will text you about your inquiry, your property, and our offer to buy it. Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out. Reply HELP for help. Carriers are not liable for delayed or undelivered messages.
(b) Calls and AI voice. We may call you using live representatives, automated dialing technology, or an AI voice assistant. We place marketing calls that use automated dialing or an artificial or AI-generated voice only to people who have given the consent the law requires. AI voice calls identify themselves as AI at the start of the call. Calls may be recorded, and we tell you at the start of the call when they are.
(c) Your consent is optional. Consent to receive marketing calls or texts is not a condition of selling your property to us or of receiving an offer.
(d) We do not share your mobile opt-in. We do not sell, rent, or share mobile phone numbers, text messaging consent, or text message opt-in data with third parties or affiliates for their marketing or promotional purposes. We share this information only with the service providers that deliver our messages on our behalf.
(e) Email. Every marketing email we send includes an unsubscribe link, consistent with the CAN-SPAM Act.
(f) Mail. We send letters and postcards to property owners using addresses from public records and commercial data providers.
(g) How to opt out. You can stop any of these communications at any time:
- Texts: reply STOP.
- Calls: tell the representative or AI assistant to stop calling you, or call 860.554.1140.
- Email: click unsubscribe.
- Mail and everything else: email privacy@clarkst.com or write to the address in Section 11 with the name and address to remove.
We honor opt-out requests made by any reasonable method, as soon as practicable and within 10 business days. We keep an internal do-not-contact list and check phone numbers against the National Do Not Call Registry where the law requires.
5. How We Share Information
We do not sell personal information. We do not share it with any other company, including other Clark St companies, for that company’s own use or marketing. Your information is disclosed only in these limited cases:
- Service providers that process data for us. We run our business on third-party software, including Airtable (database and customer records), Elevista Connect, provided by Elevista LLC (chat and voice assistant), Google Analytics (website analytics), and our website hosting, email, text messaging, telephone, mailing, and property-data providers. These providers handle information only on our behalf and under our instructions, and may not use it for their own purposes.
- Transaction parties. If you agree to sell your property to us, we give the information needed to close to attorneys, title and escrow companies, lenders, inspectors, and contractors.
- Legal and regulatory recipients. We disclose information in response to subpoenas, court orders, or government requests, or to protect our rights, property, or safety, or those of others.
- Successors. If Clark St Homes is involved in a merger, financing, reorganization, or sale of assets, information may transfer to the successor, which must honor this Policy.
We require service providers to use personal information only to perform services for us and to maintain reasonable security.
6. Cookies and Analytics
We and our service providers use cookies and similar technologies to operate the Site, measure traffic, and understand how visitors use it. We use Google Analytics for analytics. We do not currently use advertising or retargeting pixels on the Site.
You can refuse or delete cookies through your browser settings. Parts of the Site may not work properly if you do. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.
If we add advertising or retargeting tools in the future, we will update this Policy first and will treat browser opt-out signals, including the Global Privacy Control, as a request to opt out.
7. Data Retention and Security
We keep personal information as long as needed for the purposes in this Policy. Our default periods are:
| Record type | Retention period |
|---|---|
| Seller inquiries and lead records | Until you ask us to stop contacting you, plus 2 years |
| Completed purchase records | 7 years after closing |
| Chat and voice transcripts and call recordings | Up to 2 years from the interaction |
| Consent records and do-not-contact requests | At least 5 years, so we can prove consent and keep honoring your request |
| Website analytics data | The retention period set in Google Analytics |
We may keep information longer where the law requires or to defend legal claims.
We maintain reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Privacy Rights
Wherever you live in the United States, you may ask us to:
- tell you what personal information we hold about you and give you a copy;
- correct inaccurate personal information;
- delete your personal information, subject to legal and recordkeeping requirements; and
- stop contacting you, as described in Section 4.
If you ask us to delete your information and to stop contacting you, we will keep the minimum needed on our do-not-contact list to honor that request.
Some states give residents additional rights, such as the right to appeal a denied request. We will honor the rights that apply to you under the law of your state. We will not treat you differently for making a request.
How to make a request. Email privacy@clarkst.com with the subject line “Privacy Request,” or write to the address in Section 11. We will verify your identity before acting and will respond within 45 days. An authorized agent may make a request for you, subject to verification.
9. Third-Party Sites and Services
The Site may link to or use third-party websites and tools. Those third parties operate independently, and we are not responsible for their privacy practices.
10. Changes to This Policy
We may update this Policy. The Effective Date at the top shows the most recent version. We will post material changes on the Site before they take effect.
